LUCKNOW: A Lucknow bench of Allahabad high court has declined to accept that the Anti-Terrorist Squad (ATS) of UP Police was was acting in biased and mala fide manner in pursuing investigation against two 

Popular Front of India

 members hailing from Kerala -- Anshad Badarudheen and Firoj K C. The court turned down a plea to transfer the probe in the case to the 

Central Bureau of Investigation

Dismissing a petition moved by Anshad, which was filed through his brother Azhar, the bench quoted an apex court verdict saying, “The decision to investigate or the decision on the agency which should investigate, does not attract the principle of natural 

justice

. The accused cannot have a say in who should investigate the offence he is charged with.”


The bench comprising Justice D K Upadhyay and Justice Ajai Kumar Srivastava also refused to agree that using term of ‘South Terror' on a portal amounted to prejudiced and biased intention of the authorities of the 

UP Government

 and ATS against the petitioner.


“The use of such term would not per se import element of malice or bias towards the petitioner. However, we view this fact with profound concern and disapprove use of such term,” said Justice Srivastava.In its order, the bench further said, “The petitioner has been unable to show that the power of investigation has been exercised by the investigating officer of ATS in a mala fide manner. It is also not found to be a case of abuse of power and non-compliance by the investigating agency of the provisions of Code of Criminal Procedure. The investigation has also been concluded by the ATS.”


ATS had registered a case against the petitioner Anshad and another on February 16, 2021 in Lucknow. The two were arrested from Kukrail forest area in Lucknow and booked for various offences of IPC, Arms Act, Explosive Substances Act 1908, and Unlawful Activities (Prevention) Act .



Arguing for the petitioner, advocates Mohammad Tahir and Mohammad SM Alavi had submitted that the arrest was false as the duo were picked from Bihar and then booked in Lucknow. It was also argued that after the registration of FIR , the 

central government

 was required to pass an order on how to investigate the offences, but in the present case , there was no such order was passed by the Centre and hence the charge sheet filed by ATS was without jurisdiction and liable to rejected.


However, the bench rejected the said plea of the petitioner while accepting the argument of additional government advocate Shiv Nath Tilahri observing, “In the instant case, admittedly, the Central Government has not issued any direction under Section 6 (4) or Section 6 (5) of the 

National Investigation Agency

 (NIA) Act to get the 

Scheduled Offences

 investigated by the agency, therefore, the authority and power of the state government to investigate and prosecute any Scheduled Offence remains unaffected."



The bench also did not agree with the plea of the petitioner that the special ATS court took cognizance in an illegal manner.

Lucknow: Even as 42 new cases of Covid-19 were reported in the state, the number of Covid-19 free districts reached nine with their active cases count touching zero. 

The list includes Aligarh, 

Amroha

Basti

Etah

Hathras

Kasganj

Kaushambi

Mahoba

 and 

Shravasti

The total count of active cases for the state reached 729 which is 99% lesser than the peak of 3.10 lakh cases reported on April 30. The bulletin indicated that 55 districts have less than 15 active cases including 11 with just one active case left.


The number of new cases took the overall tally to 17,08,410 of which 16,84,925 have recovered, speaking for a recovery rate of over 98.6%. Among districts, more than three dozen recorded zero new cases.

Officials warned that despite the decline in cases, prevention protocol was a must to keep all trouble at bay. They also said that four Covid-19 deaths were reported in the past 24 hours taking the total to 22,756.


Officials said that the number of fully vaccinated persons had crossed the 75 lakh mark in 

UP

 on Thursday and urged people not to overlook the preventive measures as the risk of the pandemic infection and its complications remained high even now. Many states are still recording a large number of daily infections.

Two medical students from Kerala set the internet on fire after a video of their dance performance went viral on social media. Naveen K Razak and Janaki Omkumar are students of the Thrissur Medical College and both became an internet sensation after their dance video surfaced on social media.

The short clip was posted to Instagram by Naveen and his fans and followers cannot get enough of it. Naveen and Janaki put up a stunning performance as both danced to the beats of Boney M’s 1978 hit song Rasputin in their college corridor.

Their performance was inspired by dancer Vanesa Seco’s choreography, and we must add that both Naveen and Janaki absolutely nailed the steps with full energy and enthusiasm.

“Take more chances. Dance more dances. Thankyou @janaki_omkumar for your valuable time. Inspired from @vansecoo,” Naveen said in the caption of his post.

New Delhi: 

Indian Institute of Technology (IIT) Bombay will conduct GATE 2021 from February 5 to 14, 2021 as a centre-based exam. For the benefit of students, IIT Bombay has released GATE 2021 exam day instructions on the official website, gate.iitb.ac.in. As the exam is being held amid the ongoing COVID-19 pandemic, candidates will have to follow these guidelines while appearing in GATE 2021. The institute had previously released GATE hall tickets. Candidates who are yet to download their admit cards can visit the GOAPS portal and login with their enrolment ID or email and password.

On February 5, miscellaneous activities will be hosted and papers will begin on February 6. These activities include trial mock tests by zonal officials, briefing to invigilators, selection of scribes, preparation of exam centres, and optional visit by candidates to check exam centres.

As per the GATE 2021 schedule, papers will be held on February 6, 7, 13 and 14.

Over 9 lakh candidates are expected to take the exam this year. Following are the exam day instructions for candidates:

  1. Candidates will have to reach their GATE exam centres one hour before the commencement of exam.

  2. While standing at the entrance gate, follow the rope queues and floor marks.

  3. If a candidate’s body temperature is above 99.4 degree Fahrenheit, he or she will have to take the exam at an isolation area within the GATE exam centre.

  4. Candidates will be allowed to wear masks, gloves and carry personal hand sanitizer, pen, admit card, water in a transparent bottle and other exam related documents to the exam hall.

  5. When the exam is over, leave the venue in an orderly manner.

  6. Drop admit card, rough pad or scribble pad on the dropbox provided at the exam centre.

  7. Maintain social distancing at all times.
